| 摘 要： | 警卫权力代表国家力量,是国家公权力的具体体现.公民权利主要代表个人利益,体现为私权.在实践中两种权利(力)的行使在一定程度上存在着矛盾与冲突.因此,解决两者的矛盾与冲突就显得尤为重要.在分析警卫权力与公民权利冲突原因的基础上,提出了从立法上、完善机制上、适用原则上解决其冲突的方法.

| Abstract: | The power of guard-keeping policeforce is on behalf of that of the State or an embodiment of the public power. On the other hand, the right of citizens, as a private power, mainly guards the private interests. Sometimes they will be possibly going into a contradiction even conflict to a certain extent. How to settle such an issue is extremely important. Finding out and discussing the causes of the possible contradictions/conflicts between them, some ways are proposed on the bases of legislation and perfection of the law to settle well them. |
