高校管理中学生权利被侵犯及其归因分析

伴随着高校收费制度的确立,高校管理中学生权利被侵犯的问题日益受到人们的重视。针对在高校管理中学生权利被侵犯的几个普遍的问题,包括知情权被侵犯,参与权被侵犯,隐私权被侵犯,控辩权被侵犯,学习自主权被侵犯,主要从五个方面即文化因素、法律因素、经济因素、教育因素和学生自身因素分析了这些问题得以存在的原因,并探讨了解决问题的措施,如树立“以学生为本”的管理理念,完善学生管理工作的法律、法规,加强管理人员素质培养,完善教学管理制度及加强学生自身维权意识等。

Causes of Infringement of Students' Legal Right in Higher Education Administration

Since the system that all Chinese university/college students must pay tuition for their enrolment was set up, the number of the cases of infringing students' legal right in the higher education administration has been increasing and more importance has been attached to them,including mainly the rights to know necessary information and to participate legal activities, right of privacy,right to lodge complaints and right to master one's own study. Analyzes the main causes of such infringements in view of the five aspects, i.e., culture,law, economy, education and students themselves. Some measures are proposed to take to solve the problems,such as cultivating the new concept of administration on student-oriented basis and perfecting relevant law and regulations, enhancing the competence of the administrators, improving the teaching/learning system and enhancing students'self-defending consciousness for their legal right.
