| 摘 要： | 成文法典以其普遍性和确定性满足了人们对平等、安全的需求,但同时也以其自身难以克服的局限性无法满足人们要求法律个别正义、灵活适变、简短明确的价值需求。要克服成文法这种供需矛盾的局限性,必须实现严格规则与自由裁量的结合。法律原则在法律中的兴起是实现这种结合的最佳途径。

| Abstract: | The written law satisfies the demand of people’s equality and safety with its universality and confirming. But at the same time, the written law has its shortage that can’t satisfy the demand of the individual justice, the right protection, the changeable value demand. In order to overcome the limitation of the written law, we should combine the strict rule with free judgment together. The rise of the principle of law is the best path to realize this combination. |
