人权保障语境下的中国程序法制建设

人权保障是我国程序法制建设的价值目标,人权是衡量程序正义的主要价值标准。程序正义能限制权力、实现实体性人权、确认并保护程序性人权,是保障人权的基本手段。从人权保障看,当前我国程序法制建设中存在的问题,主要表现为程序正义意识不发达、程序法规不健全、现有一些程序法的条款不符合程序正义的要求。只有确立程序正义的理念,完善程序法制,才能真正尊重和保障人权。
