| 摘 要： | 公务员管理中要求公务员负有服从上级决定和命令的义务,其目的是为了保证政令畅通,保证国家机关运转的统一和效率。所以,公务员有"服从和执行上级依法作出的决定和命令"的义务。宪法规定,"中华人民共和国实行依法治国,建设社会主义法治国家",因此,即使是公务员有服从上级的义务,也必须是在法治原则、依法行政原则的前提之下,公务员服从上级的义务不应当是绝对的。
