摘    要:我国现阶段抽象行政行为全部不受司法审查 ,这与WTO规则相矛盾。WTO要求各成员方的司法审查制度有权对抽象行政行为进行审查 ,另一方面 ,WTO并不要求所有的抽象行政行为都必须接受司法审查。根据我国的宪政体制 ,可将抽象行政行为分为“立法性”和“非立法性”两类。按照WTO规则 ,前者不受司法审查 ,后者应纳入司法审查范围

Abstract:administrative actions can not be reviewed by the people's courts. It is conflicting with WTO regulation. On the one hand, WTO demands judicial review system having the rights to check up abstract administrative actions. On the other hand, not all the abstract administrative actions need to be reviewed under the WTO regulation. According to our legislative system, abstract administrative actions can be divided into the legislative and the non-legislative. According to WTO the former needn't be reviewed and the latter must.
