| 摘 要： | 物权法草案关于遗失物拾得制度的设计虽然较之以往有了一定的改进,但是其制度设计的理念忽视了物权法的主体也是一个经济人,对拾得人设定了较多的义务,只赋予较少的权利.这种价值理念和具体法律规定偏离了经济规律和法律规律,将会直接影响到遗失物拾得制度在现实中的适用效果.

| Abstract: | Although the property law draft on lost-and-found property system has been some improvements, it endows the founder with more obligations and fewer rights, ignoring the main body of property is an economic individual. This value concepts and specific legal provisions, departing the economic laws and legal rules, will affect application effects of the lost-and-found property system in reality directly. |
