| 摘 要： | 立案审查是行政诉讼进行的第一个步骤,与行政相对人的起诉权关系密切.立案审查阶段应确定形式主义审查的基本原则,适度拓展受案范围,以法律上的利害关系作为界定原告资格的标准,起诉时法官对诉讼请求和事实理由予以必要的指导,依法衔接行政复议与行政诉讼以保障公民权利的落实.

| Abstract: | Filing and checking administrative cases is the first,this is connected with the right of bringing a case before a court closely. The sector should build the principle of formalism.The proceeding should widen the scope of accepting cases,weighted the plaintiff as some interests in a specific administrative act under the litigation.Administrative judges should guideline the plaintiff about the requirements of suits and factual basis.Administrative division should handle the connection with administrative reconsideration and administrative litigation. |
