浅析未成年人犯罪的刑罚适用

在我国，未成年人犯罪在当前的刑事案件中占据一定的比例。但是未成年人犯罪与成年人犯罪，无论从指导思想还是在实践操作中都有着明显区别。对未成年人的处罚适当与否，不仅关系到未成年人的前途，而且还会对社会的发展产生重大影响。试从未成年人的刑事责任年龄划分入手，探讨我国刑法中关于未成年人犯罪的刑罚适用的基本原则，以及缓刑的适用。

A Brief study on Penalties for of Juvenile Delinquency

In our country,juvenile delinquency occupies a certain proportion in the present criminal cases. However Juvenile delinquency is obviously different from adult crime in the guiding principle and the practice operation. That the criminal law is appropriateor not for the juvenile influences the future of the young offenders as well as the development of the society. From age of criminal responsibility of Juvenile offenders , My paper explores the basic principles of penalties for juvenile delinquency, as well as the application of probation in China in terms of jureniles age difference.
