我国再保险市场的发展与法律完善

再保险是在直接保险业务发展到一定时期后产生的，通过再保险机制，能在更大范围内分散风险，保证保险公司经营的稳定，扩大保险公司的承保能力。再保险法律制度的确立与完善对于确保再保险发挥作用和再保险市场的发展都具有重要意义。我国现行的再保险法规远远不能满足我国再保险业发展对再保险法律的需求，针对这种情况，提出了一些完善我国再保险法律制度的设想，主要有：从立法上完善再保险组织架构；改善再保险市场的运行机制；充分发挥法律服务业对再保险业的促进作用等。

Re--insurance produce after spreading to a regular period in direct insurance business, through Re-insurance mechanism, to disperse risk in big range, guarantee insurance company stability, to expand one＇s own giving cover for ability in case of not increasing the capital. The flourishing develop- ment of the Re--insurance at world, the state is challenged surely at the present stage at us. Now,our country＇s regulation is far from the demand of our country＇s Re--insurance development to Re--insurance law. To the situation, this text put some propose to perfect our country＇s Re-insurance legal system： Perfect Re--insurance organization system from legislating surely; Improving the operating mechanism of Re--insurance market＇s Law service trade must give full effect to the development of Re-insurance.
