从“邓玉娇案”看媒体审判

"邓玉娇案"再次促使我们思考媒体与司法的关系。司法独立是现代法治国家的一项基本理念和原则,司法独立对于防止权力滥用、保障自由和实现社会公正具有重要意义。在司法过程中,媒体对于防止"冲突私域化"的图谋和抵制制度外势力的干预,保障当事人获得中立、公正的审判,满足公众的知情权具有积极的意义。但媒体报道也会对司法独立产生诸如"媒体审判"等的消极影响。我国的媒体审判问题有其特殊性,不宜照搬国外因应媒体审判的对策,而应在改革相关制度、推进司法独立、树立司法权威的基础上制订相关的具体制度,以实现新闻自由与司法独立的平衡。

The Media Trial as Seen from "DENG Yu-jiao's Case"

＂DENG Yu-jiao＇s Case＂ prompts us to think about the relationship between the media and the judiciary again.Judicial independence is a basic concept and principle in the modern legal states.Judicial independence has the vital significance in preventing the abuse of power,protecting the freedom and realizing social justice.In the judicial process,the media is helpful in preventing attempts to ＂make the conflicts private＂,resist the intervention of the forces outside the system and ensure the clients access to a neutral and impartial trial.It also helps to ensure the right of the public to know the truth.However,media coverage will also have some negative impact on judicial independence,e.g.＂media trial＂.The issue of media trial in China has its own particularity and it＇s inappropriate to copy the foreign models.Related specific systems should be established on the basis of some relevant reforms,promoting judicial independence and formulating judicial authority so as to achieve the balance of press freedom and judicial independence.
