居住权与我国物权法

居住权是传统大陆法系国家民法典中人役权的一种。在西法东渐时,我国并未采纳该制度。而在物权立法的早期讨论中,也鲜有人提及。但近年来,随着对物权法草案讨论的深入,居住权制度受到了学者们的广泛关注。在实践中,亦存在因为居住问题引起的纷争。因此,在当前有必要对居住权制度进行深入的分析和讨论。

Residency right and China's real right law

Residency right is a kind of personal servitude in continental law system.In the progress of moving western laws to east,China does not use this system.In the early period of real fight law legislation,few mentioned this system.But in recent years,with the discussion of real right law draft,residency right system is focused by scholars.In practice,the dispute about residency right exists.Thus,residency right system is necessary to be analyzed and discussed currently.
