高校学生权利救济的法理分析

在传统的教育体制下,中国的高等教育是以公办为主、具有福利性质的教育,学生接受高等教育基本上不交费或只交一部分费用.在这种情况下,高等教育管理部门都比较漠视学生的权利,学生习惯循规蹈矩.久而久之,学生自身应有的权利被渐渐地忽视了,这种权利意识的淡薄,直接导致了学生走向复杂的社会后生存与竞争能力的不足.但是,在"依法治国"的今天,在缴费上大学的前提下,高校学生的权利意识得到了普遍提高,权利救济意识也得到了普遍增强.因此,高校学生如何进行权利救济,是一个值得探讨的问题.

Under traditional education system,China's higher education is mainly run by government and is the education with welfare and students do not pay tuition fee or only pay a part of fee.Under this system,management departments of higher education ignore the rights of students and students follow the law and regulations.As time passes,the rights of students are ignored,which results in disability of students in competition of the society after graduation.But under the situation of "governing the country by law" and students' attending school by paying tuition fees,the consciousness of students' right is promoted and right relieving consciousness is promoted.Thus,it is an issue for college students to implement right relieving.
