欧盟航空碳排放权交易机制评析及中国的应对

摘    要:2012年1月1日起欧盟通过征收航空碳税的形式将民用航空领域纳入其碳排放交易体系之中,这一做法受到了国际社会的强烈反对。欧盟这一单边、强制性、未经其他国家同意的做法违反了规制气候变化的《气候变化框架公约》和《京都议定书》,也违反了规制民用航空的《芝加哥公约》,不仅损害了国际气候谈判取得的成果,也侵犯了非欧盟国家的合法利益。面对其产生的国际影响,国际社会已开始采取相应的措施进行应对,作为发展中国家的中国亦应当在坚持共同但有区别责任原则的前提下采取积极的应对策略。

Abstract:From Jan. 1s', 2012, EU will include international civil aviation into its Emission Trading System, invoking strong protests from international societies. EU unilateral compulsory behavior violated not only United Nations Framework Convention on Climate Change well. It not only rests of non-EU damaged the results achieved in international countries. The international communities have and Kyoto Protocol but Chicago Convention as climate negotiation, but also hurt the legal intetaken countermeasures, and China, as a developing country, should also take countermeasures while insisting on principle of common but differentiated responsibilities.
