刑罚发展的世界性趋势与非监禁刑在我国的前景

20世纪下半叶以来,伴随着世界范围内犯罪非刑罚化和刑罚非监禁化的浪潮,西方发达国家逐步控制和减少监禁刑的适用,加大非监禁刑的适用力度,实现了刑罚适用模式由监禁刑为主向非监禁刑为主的转换。由于传统重刑主义的影响、"严打"的刑事政策导向、行刑体制的桎梏以及立法技术的粗疏,我国的刑罚体系仍以监禁刑为主,非监禁刑的适用步履维艰。尽管如此,非监禁刑在我国仍有广阔的前景:社会结构的转型、犯罪人的变化以及国际社会的努力为非监禁刑的大量适用提供了现实条件。

The Global Development Trend of Penalty and the Prospect of Non-custodial Penalty in China

In the 2nd half of the 20th century, with the tide of the Non-Penalization and Non-imprisonment in the world, the developed countries in the West gradually reduced the application of custodial penalty, augmented the use of Non-custodial penalty and realized the transformation of penalty applicable model from custodial penalty to non-custodial penalty. Because of the influence of the idea of traditional severe punishment, the criminal policy towards "punish with severity", the shackles of penalty execution system and the roughness of legislation skill, custodial penalty still remains the center of the penalty system in China, and non-custodial penalty is applied with difficulty. Nevertheless, non-custodial penalty has a wide prospective in China, because the change of social structure , criminals, and widespread participation will prepare the ground for the wide application of non-custodial penalty.
