| 摘 要： | 孔子"仁"学思想体系本身的内在规定性和宇宙扩张论的深入研究,是揭示孔子"仁"学的理论本质及其法律思想的主要研究方法.孔子的"仁"学宇宙观被《周易》"象思维"所贯穿,是孔孟之道的理论核心,也是中国传统政治法律观的主要理论.它使中国法律思想和现实制度沿着"应然之善"的伦理实体与"以礼代法"的德主刑辅发展下去,成为整个中华法系的传统法律思想和现实制度的主要理论形态.

| Abstract: | The inherent stipulation of the ideology system of Confucius'Benevolence Philosophy itself and further study on the universe extension theory is the main research method to reveal the theory nature and law theory of Confucius' Benevolence Philosophy.The universe view of Confucius' Benevolence Philosophy is run through by the Appearance Thinking in the Book of Changes,which is the theory core of Confucius philosophy,and the main theory of traditional Chinese politics and law as well.Thus Chinese law theory and reality system is made to develop along with the ethic body of Kindness according to Nature and the principle of virtue first,with auxiliary penalty,named Replacement of Law by Courtesy,and then become the major theory formality of the traditional law theory and reality rule of the whole Chinese law system. |
