| 摘 要： | 作为罪刑法定主义的实质侧面,明确性是对刑事立法的一项基本要求,即立法者不得制定构成要件不明确、行为犯罪化的边界不清晰、法定刑幅度不确定的刑法规范.刑法明确性原则的确立,有其深刻而复杂的多维基础.我国现行刑法离明确性的要求尚存较大的差距,为了贯彻和体现刑法明确性原则,需要改进立法语言、完善立法技术、规范刑法解释,以及建立刑事判例制度.

| Abstract: | Precision is the prerequisite for criminal law legislation,which means that the legislator should avoid any hint of inaccuracy in the components,boundaries and degrees of laws and sentences.The establishment of the precision principle is thus based on multiple factors and in China in particular,because of the inadequacy in this field, much effort is needed in the implementation of this principle in terms of legislation language,techniques,interpretation and indictment system. |
