| 摘 要： | 基于行政自制控权逻辑及比较分析结论,我们发现,对裁量基准的公开性,不能简单苛以"必须公开"之观念。恰恰相反的是,"相对公开"的理论预设不仅能尊重执法效率之需求,同样也可以避免理论研究过于主观之弊端。

| Abstract: | Based on an assessment of the administrative self-control theory and a comparative study,the authors maintain that absolute openness shall not be the sole criterion for the administrative judgment,and,instead,relative openness may not only guarentee the effeciency of legal procedures,but also help prevent extreme subjectiveness in theoretical studies. |
