转型期民间投资及其法律规制的制度逻辑--一个关于中国经济法现实运作基础的经验考察

本文立足于已持续二十多年的中国市场化取向的渐进改革,借助发生在甘肃省古浪县时间跨度超过15年的农村"机井"投资纠纷司法个案,对其中牵涉到的农业生产基本设施(机井),及其所引发的公有产权(特别是集体产权)与私人产权之间因"产权交易"而展开的"博弈"的具体分析,揭示了中国社会经济转型期民间投资的真实和普遍语境--即始终存在于同公有产权和国家权力相互碰撞和纠缠的夹缝中.在此基础上,通过反思现有法学研究及司法审判在方法和思路方面的缺憾,对转型期民间投资法律规制的制度逻辑进行了探讨,并结合其他领域的民闻投资实践,对转型期中国经济法存在和发挥作用的现实基础进行了思考.

On the Private Investment in Rural Infrastructure Construction in China's Transitional Period

Based on the case study of the legal conflicts concerning the investment in the water well construction in Gulang County, the paper analyses the ownership conflict arising from the private investment in public facilities in rural China, particularly at a time when privatization is beginning to make its entry into the countryside. The authors think that the private ownership is in an awkward situation, surrounded by public ownership system and state authority. Therefore, the legal handling of such issues, modeling on Western legal system, is of little effect wherr China's present situation is at a critical moment of transformation. The paper further discusses the function of the economic law as regard such matters.
