| 摘 要： | 关于婚内强奸行为的定性问题,理论界众说纷纭,莫衷一是。基于另一个角度,从两起婚内强奸案的真实案例出发,当可论证类似疑难案件判决的合法性基础,以及使疑难案件判决获得合法性基础的若干司法技术和策略。

| Abstract: | There are different opinions towards the legal nature of the rape happening in marriage.Based on two real cases of the rape happening in marriage,this article illustrates the legitimacy of hard cases similar to the two cases mentioned in this article and puts forward techniques and strategies that can make the judgments of hard cases gain legitimacy. |
