| 摘 要： | 我国现有行政主体概念存在诸多缺陷,在公共行政改革的冲击下,更加明显。在行政主体概念的外延已经发生嬗变的情况下,应该把现有行政主体分为行政主体与公共行政体。公共行政体只是指在公共行政组织体系中能够代表行政主体依法独立行使公共行政职权,并对其公共行政行为以担当行政争议当事方的方式,承担形式法律责任的组织。

| Abstract: | The existing concept of administrative subject contains many defects,which are more obvious under the impact of the public administration reform.In the case of the diversification of the extension of the administrative subject,it's the only way to divide the existing administrative subject into two parts,administrative subject and public administrative agency.The public administrative agency is the organization in the public administrative organization systems,which is authorized exercise public administrative authority independently,and is ostensibly charged with the legal liability from its own public administrative action,by acting as a party of administrative dispute. |
