民事纠纷解决的第三领域——法院委托调解

委托调解是对法官主导下诉讼调解工作适度社会化的新模式探索。法院委托调解是国家力量与社会力量共同参与的纠纷解决机制,在民间调解人指挥调解程序的背后是法院司法权的支持和支撑。委托调解虽然以当事人的合意为基础,但因为调解程序的开始和调解结果都有法院司法力量的介入,法官裁决或命令的作出有时会使当事人的诉讼权利受到一定的限制,因此,在法院委托调解中也应当强调当事人的程序保障权。
