适用农业反垄断豁免的主体界定

反垄断法第56条是我国农业反垄断豁免的法律根据。从该条保护农业、促进农村经济组织发展的立法目的解释,农业生产者是在农业领域（大农业）,直接从事农产品（初级农产品）生产、加工、销售、运输、储存等经营活动的农民、农业企业及其他组织。农村经济组织是＂农民依法自愿联合组成,对内不以营利为目的,依据民有民管民受益原则,为其成员提供生产经营服务的合作性经济组织。＂包括农村集体经济组织、农民专业合作社、农民专业协会和农村股份合作制企业。
