"四荒"土地使用权论纲

在"十分珍惜、合理利用"的土地开发利用方针指导下,对搞活农林牧副渔有着重大潜力可挖的"四荒"土地应格外受到关注.确立"四荒"土地使用权的法律地位尤其是民法地位,是解决问题的关键所在.我国正在进行的物权立法应对"四荒"土地使用权予以调整和规范,包括它的取得、期限、主体、客体、权能、效力以及法律保护等内容.这对于充分、合理和有效地利用土地资源,保持自然资源的可持续发展具有不可低估的现实意义.
