生态效率视角下农村垃圾减排与利用的法律规制

生态效率是基于环境、经济系统相互关系的测评标准,同时兼顾了经济效益和环境效益。伴随着我国农村快速建设的进程,农村垃圾的大量产生和低效利用带来了严重的环境资源问题,背离了生态效率原则的要求。与美国、德国、日本等发达国家相比较,我国在依法规制农村垃圾减排与利用方面还存在立法理念落后、专项立法欠缺、监管体制不合理、具体制度不完善和法律责任不明确等制度缺陷。在生态效率原则的指导下,从农村垃圾减排与利用两个方面,进一步完善我国农村垃圾管理法律制度势在必行。

The Rural Rubbish Reduction and Utilizing Legal System under the Review of the Eco-efficiency

The eco-efficiency is the evaluating standard based on the relationship between environmental and economic system,and considering economic and environmental benefits.With the rapid process of development of China’s rural area,a large number of rural waste and inefficient use of resources brings about serious environmental problems,departing from the requirement of the principle of eco-efficiency.Compared with the United States,Germany,Japan and other developed countries,there are still deficiencies in the system such as lagging legislative philosophy,the lack of specific legislation,unreasonable regulatory regime,imperfect specific liability system and unclear legal responsibility in rural waste reduction and use in China.Under the guidance of eco-efficiency principle,it’s imperative to further improve the legal system and management of China’s rural from waste reduction and utilization.
