| 摘 要： | 法定解释是否有一种优先性或优先性规则，学界对此纷争不一。经过对各国操作性解释实践的比较分析，可以认为基本上不存在一种普遍性的优先性规则。即便是实际存在的以及理论建构的优先性规则，也是一种程序性的优先性规则，而非有关重要程度的优先性规则。

| Abstract: | The academic community is still disagreeing about whether there exists a priority or rule of priority in legal interpretation.Through a comparative analysis on practices of operative interpretation in several countries,it ought to be impossible for a universal rule of priority to be existed.Even the existing rule of priority and the theoretic-construction one are not one kind of rules of priority over material degree in ranking different interpretive elements but one of procedural rules of priority. |
