城市拆迁纠纷解决机制实证研究——以安置补偿纠纷的行政裁决机制为中心

课题组对s县的拆迁行政裁决机制进行了全面调查。该县行政裁决机制表现出两方面的特点：其一是以“和谐拆迁”为指导思想，其二是多元化的调解办案机制。行政裁决的客观效果表现较好，但主观效果则不尽如意，并未消除当事人内心深处的冲突。进一步的分析发现，现行裁决机制的主要问题首先是裁决主体不具备中立性，其次是裁决程序具有相当的压制性。拆迁行政裁决机制的未来应从问题导向转向从根本上化解纠纷、消除不满。为此，在选择法治化的行政裁决模式的前提下，应分离拆迁管理与拆迁裁泱职能，适当扩大拆迁裁决的受案范围，改革现有的房屋价格评估机制。

Empirical Research on Settlement Mechanism of Urban Demolition Disputes： Focus on Administrative Adjudication Mechanism of Resettlement Compensation Disputes

The research group conducted a comprehensive survey of the administrative adjudication mecha- nism of demolition in S County. It shows two characteristics. The first is the ＂harmonious demolition＂ as the guiding ideology, and the second is ？the diversified mediation mechanism. The objective effect of the administra- tive decision is better, but the subjective effect is not entirely wishful, because it does not eliminate the conflicts in the heart of parties. Further analysis found that the main problems are, firstly the ruling body does not have the neutrality, and Secondly the ruling procedure is repressive. In future, the administrative adjudication mech- anism should fundamentally resolve disputes and eliminate dissatisfaction from problem -oriented approach. To this end, under the premise of choosing administrative adjudication mode rule of law, the functions of relocation management and relocation decisions should be separated, the scope of the demolition ruling of the cases should be appropriately expanded, and the existing housing price assessment mechanism should be reformed.
