| 摘 要： | 我国正在起草民法典,这是继《合同法》颁布后又一次在我国建立情事变更制度的良好契机。我国当前解决情事变更问题的方式存在不足,我国应当明确规定情事变更制度。相较通过判例、出台新的司法解释、在单行法或民诉法中建立情事变更制度,在民法典债编总则中规定情事变更制度是最佳选择。
