| 摘 要： | 刑法关于环境犯罪的立法已经不能适应科学发展观背景下我国环境保护的现实，具有明显的缺陷，对此，应该在立法模式、犯罪构成要件、刑法控制范围及刑罚处罚等方面加以完善，以营造一种有利于可持续发展的刑事法制环境，有效抗制环境犯罪，保护环境资源。

| Abstract: | The legislation of environmental crimes in criminal law has not adapted the fact of our countries environmental protection in the scientific concept of development,and there are some obvious limitations in criminal law.In order to constructing a criminal legal condition,which are in favor of sustainable development, effectively restrain environmental crimes and protect environmental resource,legislation perfecting should be taken in legislation model,criminal condition,control range of criminal law and penalty. |
