行政附带民事调处相关法律问题探究

行政主体调处一定范围的民事纠纷,在世界各国已成通例.在我国,行政附带民事调处的法律依据,已包括在现行许多法律、法规之中.行政附带民事调处复议必须具备三个条件应以行政复议案件的成立为前提;两个不同性质的请求之间具有内在关联性;有关联的民事请求在行政复议过程中提起.对行政附带民事调处及其复议进行司法审查不仅有客观现实性,也有充分的法律依据,主要途径是由人民法院行政庭作为行政附带民事诉讼处理;此外, 人民法院可以通过受理行政机关强制执行行政附带民事调处及其复议决定的申请,在执行前对相关行为进行审查.

A Study on Laws Concerning Administrative Incidental Civil Mediation Procedure

It is a common practice for administrative body to mediate a certain range of civil disputes in countries all over the world. In China, the legal basis of the administrative incidental civil mediation is found in many existent laws and regulations. Three preconditions should be met for the reconsideration of the administrative incidental civil mediation: the legal acceptability of the administrative reconsideration case; the inner correlation between two claims of different natures; the civil claim's being advanced in the process of the administrative reconsideration. Judicial review of the administrative incidental civil mediation case and its reconsideration is not only based on the objective reality but also the tangible legal system. The main approach is that the administrative courtroom of people's court manages it as a case of administrative incidental civil litigation. Besides, by accepting from the administrative organ the application to the mandatory enforcement of the decision on the administrative incidental civil mediation case and its reconsideration, people's court can examine the behaviors concerned before taking action.
