加入WTO对我国外资法的影响

2001年3月颁布的《中华人民共和国合资经营企业法修正案》,对不符合市场经济尤其是不符合国际惯例和WTO规则的相关条款进行了重要的修改,但这次修改不够彻底,与WTO规则尚存在一定的差距。本文从分析WTO的相关规则入手,指出我国外资法仍然存在的问题,并试图从明确立法权限、增加法律透明度、与国际惯例接轨及制定统一的“外商投资企业法”等几个方面提出改善建议。

The Influence of Joining WTO on Our country's foreign Capital Law

In March,2001 ,"the People's Republic of China pools capital management enterprise law"was put to practise It revised some regulations and rules which were not in accordance with the international lonventions, But this revision is insufficient and still remains in certain disparity to WTO rules. This article analyzes the related rules of WTO, points out that our country's foreign capital law still has some problems , anc attempts to make clear the legislation jurisdiction, law transparency,connects rails with the international convention arid formulates the unified "Foreign Investment Enterprise Law"and other aspects to put forward proposals for its improvement.
