关于完善农民工社会保障立法的思考

我国有关农民工社会保障方面的立法主要是国务院及地方各级人大、政府制定的法规和规章。它存在着立法层次低,法律效力弱,立法内容面窄、体系不健全及立法实施效果不理想等问题。从法理和宪法角度分析,我国应为农民工完善社会保障立法,主要是提高立法层次,近期内由国务院针对有关农民工的各种社会保障项目统一制定行政法规,远期则由我国立法机构出台单独的农民工社会保障法;完善立法体系,统筹规划合理安排农民工的社会保险、社会救助、社会福利等社会保障项目,农民工立法应以社会救助为基础,以社会保险为主体,以社会福利为重要补充;同时加强农民工立法的执法司法力度。

Thoughts about perfecting social security legislation for farmer-workers

In China,the social security legislation for farmer-workers are mainly about rules and regulations made by the state council,and local NPC and government.Therefore,there exist some problems in the legislation such as the low level,weak enforcement,narrow content,incomplete system,and unsatisfactory execution.On a homological and constitutional basis,China should perfect the social security legislation for farmer-workers by raising the level of legislation,and the state council make out a punitive administrative regulation,and the legislative department should promulgate a law to protect farmer-workers' social security system including a reasonable social insurance,social assistance,and social welfare.The legislation for farmer-workers should be based on social assistance,should depend mainly on social insurance,and should be compensated by social welfare.The execution of the legislation for farmer-workers should also be reinforced.
