从"契约到身份"命题看民法的本位

随着社会、经济条件的变化,民法也在不断地向前发展,有学者将这种发展趋势归纳为所谓“从身份到契约”的反向运动———“从契约到身份”。该文分析了由此论题引发的民法的本位之争,对相关观点进行了剖析并提出了自己的观点,认为民法无论是立法还是司法实践仍然应体现以人为本的思想。

Discussing the Standard of Civil Law from the Proposition "from Contract to Degree"

With the development of the condition of society and economy,civil law is progressing.Some scholars call this trend "from contract to degree" which is reverse movement of "from degree to contract".This article starts with this proposition and analyses the controversy about civil law standard educed by it.The author puts forward criticism on points of view related and makes a conclusion that modern civil law should also take private subject right as the standard.
