论消费者索赔权之实现

摘    要:消费者索赔权是在消费者因为购买商品、使用商品或者接受服务时,受到人身、财产损害时,依法获得赔偿的权利。该权利与消费者安全保障权、知悉真情权、公平交易权、维护尊严权等密切相关,尤以与保障消费者安全权的关系最为密切,是一项非常重要的权利。本文从我国消费者索赔权实现之现状着手,分析概念的同时,探讨消费者索赔权内容及法律缺陷,提出了完善措施,具有一定的积极意义。

Abstract:Consumers' claim right means that consumers can claim for compensation when they suffer from property damage or personal damage in the process of purchasing,using commodities or receiving services.This right has close relationship with consumers' right claiming for security,real information,fair deal and dignity.It is really important and connected more closely with consumers' security right.The thesis analyzed the status of realization of consumers' claim right,the concept,the content and legal defect,then presented some measures on how to perfect it.
