| 摘 要： | 本文通过分析诚实信用原则的基本含义、法理精神及其在刑事司法实践中的表现 ,认为诚实信用原则不仅仅是私法领域的最高准则 ,还应当成为公法领域中的指导原则。指出在刑事诉讼中确立诚实信用原则 ,会促进刑事司法健康、有序的运行。

| Abstract: | Starting from the credit and honesty principle's fundamental meaning,legal principle's spirit and its embodiment in the practice of criminal judicature,this paper holds that the credit and honest principles are not the maximum norms of the sphere of the private laws but guiding principles of the sphere of the public laws,and points out that establishing the credit and honest principle in the criminal suit could even promote the health and orderly development of criminal judicature. |
