试论环境污染犯罪因果关系推定原则

环境污染犯罪是一种新型犯罪,环境污染犯罪的特征决定了因果关系推定原则是认定环境污染犯罪因果关系的主流性原则。同时该原则有自己的特质,起主要内容在四大学说中体现出来。尽管环境污染犯罪推定原则的应用具有条件性但是它克服了传统刑法因果关系运用的缺陷,利于打击环境犯罪、与国际环境保护制度社会接轨。对我国司法实践有较大借鉴意义。

On the Principle for Presuming Environmental Pollution Crime Based on Cause-effect Relationship

Environmental pollution crime is a recently emerging crime.The principle for presuming the crime based on cause-effect relationship has proved a mainstream principle for establishing its nature.The main ideas of the principle are embodied in the four doctrines.In spite of limits in its application,the principle,noted for conforming to the prevailing international environmental protection regime,can overcome the inherent defects of conventional criminal law and help crack down on environment-related crimes.
