农地承包制和农地流转的冲突与协调——兼论《土地承包法》流转规范设计的不足及完善

现行农地经营制度是以农户家庭承包、分散经营为本体的，承包责任制虽是农地流转不可动摇的体制基础，但其初始设计与农地流转政策目标和现实运行机制之间存在偏差，反而制约了农地流转。基于现代农业规模经营的实践分析，从两者冲突的对应性出发，需要在法律制度层面进行合理协调，既要完善家庭承包制，建立完全物权化的土地承包经营权流转法律机制，也要创造有利于农地流转的政策环境并采取相配套的法律保障措施。

Conflict and Coordination between Agricultural Land Contract System and Agricultural Land Transfer on the Shortage and Improve the "Rural Land Contract Law"

The basic characteristics of China's existing land management system is agricultural land contract system and decentralized management.Although family farmers' contract is a solid system basis for the transfer of agricultural land,there's a gap between their initial policy goals and actual operating mechanism,which restricted the circulation of agricultural land.Based on the analysis of the practice of modern agriculture scale operation,it is necessary to improve the household contract system,establishing legal mechanisms with full property rights to agricultural land transfer and creating a favorable external environment for agricultural land transfer and taking corresponding measures.
