| 摘 要： | 调整和规范农村宅基地的制度包括：农村宅基地法律制度和农村宅基地政策制度。根据农村宅基地所有权性质演变与原始取得宅基地权利的主体演变，可将农村宅基地制度分为农村宅基地农民私人所有、农民享有宅基地所有权，宅基地归生产队集体所有、农民享有宅基地使用权，宅基地属于农民集体所有、农村居民和城镇居民享有宅基地使用权，宅基地属于农民集体所有、农户享有宅基地使用权等四个阶段。不同的阶段具有不同的法律政策内容及其特点。

| Abstract: | The systems adjusting and standardizing countryside homestead include both the legal institutions and policy system.According to the evolution of ownership and the body of original acquisition of countryside homestead,the homestead system in country may be divided into four stages as following:farmers owned their homestead and enjoyed the rights for the homestead at the same time,production teams owned the homestead while the farmers enjoyed the land tenure,collectives owned the homestead and residents in country and town enjoy the right to use land,the homestead belongs to the farmer collective and the countryside resident and the township dwellers enjoys the homestead right of use.Different stage has different legal policy content and characteristic. |
