证券纠纷非诉讼解决机制的构建

当事人程序主体性原则的核心在于应将当事人作为程序适用的主体而非客体，充分尊重当事人的程序选择权和处分权，为证券纠纷非诉讼解决机制的构建奠定理论基础。目前，诉讼是解决证券纠纷的主要方式，但其面临着诸多困境，而非诉讼机制在证券纠纷领域的具体应用不足，难以为当事人提供有效的救济。基于“有限司法”理念、证券纠纷的专业性以及非诉讼解纷机制的高效性、灵活性、保密性等优势，应立足于当事人的利益诉求和意思自治原则，着重完善仲裁和调解等非诉讼机制，使之成为与诉讼机制并存、协调衔接的证券纠纷解决方式。

Construction of Alternative Dispute Resolution Mechanism of Security Disputes

The core of the principle of the parties＇ procedural subject is that the parties should be treated as the subject rather than the object of the use of the procedure, and the parties＇ rights of procedural option and disposition must be respected adequately, which lays theoretical basis for structuring alternative dispute resolu- tion mechanism of security disputes. At present, the litigation is the main way of settling securities disputes, but it has some shortages：the alternative dispute resolution is put into use inadequately in the field of security dis- putes, it can not provide effective relief for the parties. Based on the concept of limited judicial, profession of security disputes and the superiority of dispute resolution mechanism such as high efficiency, flexibility, privacy and etc. , we should base on the interest appeal and autonomy of parties, focus on perfecting dispute resolution mechanism including arbitration and mediation, and make it as the way of settling securities disputes which is simuhaneous and harmonious with lawsuit.
