| 摘 要： | 目前我国有大约2000万从事家政服务的人员,然而家政服务工作的劳动属性却一直无明确定性,家政工人不被认定为法律上的劳动者,加之传统社会观念限制,使其备受社会歧视。"家政工"的称呼有利于把家政人员与劳动法的其他工人同等看待,避免歧视,并纳入劳动法调整,保护家政工权益。只有真实地把家政工劳动权利落实到法律文本上,并在社会上强制推行,才可以真真切切地保护到家政工的劳动权利,也才是真正意义上的承认其法律上的劳动者地位。 |

| Abstract: | As of now China has about 20 million people engaged in the domestic service industry.However,the nature of the work provided by domestic servants has not received precise legal definition.Domestic servants have not been recognized as laborers by law;this negligence plus traditional social stigma has precipitated contemporary social discrimination for the group."Domestic Worker" as an appellation brings the group to an equal footing with other types of workers in the eyes of the Labor Code and helps protect their legal interests and lessen the discrimination leveled at them.This paper argues for the codification(and the enforcement there of) of the work-related rights of these service providers,without which the welfare of these domestic workers cannot be guaranteed. |
