吸收犯疑难问题新探

吸收犯是罪数形态理论上争议最大的问题之一,其中的若干争议直接涉及吸收犯在理论上是否还有存在的必要性。在理论上,吸收犯存在的必要性是显而易见的。吸收犯只发生在同一犯罪过程中的同质数构成要件行为间,它是实质一罪;吸收犯的吸收关系是指在同一犯罪过程中,不同的行为阶段实现了多个犯罪构成,从而形成的多个犯罪构成对数构成要件行为在评价上的包容关系;它是同一犯罪过程中同质数构成要件行为间的吸收,其表现形式应是高度行为吸收低度行为。

A New Comment on the Problem of Absorbable Criminal

Absorbable criminal is one of the most contentious problems in the form of quantity of crime in the theory, some disputes of which directly involve the necessity of the existence of the absorbable criminal theoretically. Through the comparable analysis among several viewpoints, this paper believes that the existence of the absorbable criminal is necessary theoretically; It only exists among the necessary elements of the same criminal process, it is one crime in nature. The absorbable relationship of the absorbable criminal is actionably a tolerance one toward several constitution behavior by several constitutive elements coming from different action phrases in the same criminal process. Several constitutions behavior with the same nature will be absorbed by each other, manifesting that serious behavior absorbs light behavior.
