通过法治实现公平正义

公平正义是含义极其丰富、见仁见智的政治哲学概念,法律意义上的公平正义则具有明确性、规范性、统一性等特质,因而以法治的方式规定并实现公平正义,成为现代法治社会的普遍选择。当前我国社会一方面存在种种不公现象,另一方面也出现滥用公平正义概念寻求不正当利益的现象,这就需要把对公平正义的不同认识及其诉求尽可能纳入法治轨道,通过法治方式、途径和程序实现公平正义。民主立法、依法行政、公正司法、自觉守法是以法治思维和法治方式实现公平正义的重要环节和基本途径。

To Achieve Fairness and Justice by Rule of Law

Fairness and justice is a concept of political philosophy with abundant connotations and different views. In legal sense, fairness and justice has the characteristics of clearness, standard and uniformity. Thus it has become a common choice for the modern society of law to achieve fairness and justice by the rule of law. Nowadays, in China, on the one hand, there are different kinds of unfair social phenomena, on the other hand, there are also the phenomena of seeking unjustifiable interests by abusing the concept of fairness and justice. So it is necessary to take the different understandings and appeals into the trail of rule of law as far as possible in order to achieve fairness and justice by legal ways, approaches and programs. Democratic legislation, law - based administration and judicial justice and law abiding are the key link and basic methods for achieving fairness and justice with legal mode of thinking and working way.
