| 摘 要： | 共同危险行为的免责事由，专指共同危险行为人通过举证证明自己的行为与损害结果没有因果关系而免责的问题，而非证明自己非共同危险行为人的问题。针对行为人免责的事由，目前学术界存在着肯定说与否定说的争议。通过对肯定说和否定说的分析，可以看出，肯定说才是符合法律公平公正精神的学说。

| Abstract: | Joint dangerous act exemptions refer to the issue that the doer of joint dangerous act prove their behavior did not result in the damage through evidences,rather than to prove itself non perpetrator.At present there are academicall dissensions on exemption for the doer,i.e.affirmation and negation.Through the analysis of both theories the penman believes that affirmation is consistent with the spirit of fair and equitable doctrine. |
