| 摘 要： | 医患法律关系应定位于平等主体间的民事法律关系及合同法律关系。上述法律关系包括主体、客体和内容三种 要素。医患法律关系主体违反法律规定或双方约定,应承担民事责任、行政责任和刑事责任。

| Abstract: | The legal relationship between medical establishment and sick men should be located as civil legal relationship and contractual legal relationship among equal subjects, which include three elements of subjects, objects and contents. So long as the subjects of legal relationship of medical establishment and sick men breach legal provision or engagement, they should assume civil liabilities, administrative liabilities or criminal liabilities. |
