科研协同创新中的专利利益平衡研究

企业、高校和科研机构是重要的技术创新主体，他们在创新过程中的资源互补性使得科研协同创新成为必然选择。分析现阶段科研协同创新中的专利利益分配问题，采用博弈理论，建立专利利益分配模型进行研究。通过研究发现：专利收益分配系数与付出的努力水平、贡献系数的平方成正向关系，与创新成本系数的平方成反向关系。对完善我国科研协同创新中专利利益分配机制提出建议：将贡献大小作为合作各方专利利益分配的衡量标准，扩大高校和科研机构对协同创新中产生的专利的使用、处置和收益分配的自主权，完善职务发明专利利益分配相关的法律法规与政策，地方政府也有责任出台具有可操作性的实施办法。

Research on Balance of Interests of Patents Result from Industry-University-Research Institute Cooperative Innovation

As the principle parts of technological innovation,the complementarities of enterprises, universities and research institutes in innovation resources make them take part in cooperative innova-tion together.This paper analyzed the problems of interests’distribution of patents result from the in-dustry-university-research institute (IUR)cooperative innovation at this stage,and using the game model to analyze the interest’s distribution of patents mechanism,this paper found that the interests’ distribution coefficient is proportional to the effort level and the contribution coefficient squared.The interests’distribution coefficient is inversely proportional to the innovation cost coefficient squared. Finally,suggestions were put forward to further improve the interests’distribution of patents mecha-nism of the IUR cooperative innovation:the partners shall assign interests of patents according to their contributions to patents,and we should expand the autonomy of universities and research institutes to use patents,manage patents and distribute interests of patents result from the IUR cooperative innova-tion,and we should perfect the interests’distribution laws and policies related to the professional in-ventions,and the local governments also have responsibilities to formulate their own specific measures for implementation.
