| 摘 要： | 合议庭的评议是审判运行机制中的最核心部分,其合理运作直接决定着审判制度功能的发挥.构建一个科学、合理的评议程序是实现司法裁判结果公正、合理的有效保障.我国有关评议制度的法律规定本身并不健全,合议庭评议规则存在漏洞.合议庭可将各法官对某案件态度的偏好汇集成群体偏好,然后做出优劣排序或从中选优而形成一个总的裁判决策.

| Abstract: | The deliberation of collegiate bench is the central part of the trial operation mechanism, which will directly determine the operation of the judicial system. Constructing a scientific and reason- able evaluation program is the effective safeguard that realizes fair and reasonable judicial referee re-suits. The law on deliberation system in China itself is not sound, because there are loopholes in eval-uation rules. The collegiate bench condenses all individuals＇ preferences of judges into group prefer-ence and arranges in order or select the best scheme by comparison to form a general juridical deci-sion. |
