| 摘 要： | 伴随着当今中国城市化的快速推进，土地取得、利用与保护之间的矛盾逐渐成为一大社会问题。在介绍近代城市萌芽与发展的基础上，指出城市化的原动力是资本主义与工业化，分析域外先发国家城市化进程中土地取得与利用的经验和教训，认为其采取的法律与政策规制值得借鉴，以拉美为代表的脱离实际的城市化诚为前车之鉴。
