| 摘 要： | 中国的法制现代化无法忽视少数民族地区的法制现代化问题。从分析传统的少数民族习惯法的形态及其特征入手,借用法制现代化的发展模式的分析进路,对少数民族习惯法的现代性转型进行比较研究,指出少数民族的习惯法在向现代型法律的转化过程中不能忽视本民族的法律文化传统以及对待其转型的态度。

| Abstract: | In the process of the legal modernization of China,the parts of the minority customary law should not be neglected.It begins with analyzing the types of the traditional minority customary law and the character of the legal culture.Then the analysis methods of the process of the legal modernization patterns is used to comparatively study the character of the minority customary legal transformation.At last,the conclusion is drawn that the transformation process of the minority folk law from the traditional to the modern should not neglect the local traditional legal culture and the attitude towards this transformation process. |
