| 摘 要： | 如何规范基因隐私权是生命科学领域立法的关键问题。基因隐私权表现出独有的法律特征 ,对其立法有利于确立公民人权理念。世界各国正将基因隐私权作为隐私权法的补充性规定。我国基因隐私权立法存在着不足 ,为了完善基因隐私权必须明确其法律保护的基本原则 ,建立直接法律保护体系。

| Abstract: | How to standardize people's right to the privacy of their genes is a crucial problem in making laws in the area of life science. The protection of people's right to the privacy of their genes shows the unique characteristic of laws. Making laws to protect people's this kind of right is helpful to establishing the concept of citizens' human rights. All the countries of the world are making the privacy right of genes a supplementary stipulation to their law of privacy right. However, there are existing insufficiencies in China's laws for protecting the privacy right of genes. In order to perfect the privacy right of genes, it is necessary to clarify the basic principles of its legal protection, and to establish systems for the direct legal protection of this right of the people. |
