| 摘 要： | 刑事普通救济程序的功能可分为正功能和负功能,其中正功能又可分为目标功能和附带功能。目标功能的实现途径可分为能全面实现所有目标功能的途径、可选择性实现目标功能的途径和仅能实现法律救济和法律统一功能的途径。负功能的弱化可通过限制上诉和简化程序来实现。我国刑事普通救济程序的完善应从目标功能本身的完善、目标功能实现途径的完善和负功能弱化途径的完善三个方面着手。

| Abstract: | The functions of general relief procedure in criminal procedure can be classified into positive functions and negative functions,and the positive functions can be classified into functions as objective and functions as by-product.The way to realize functions as objective can be classified into the way which can realize all functions as objective,part or all functions as objective,and only realize the function of legal relief and legal unity.To limit appeal and simplify procedure can reduce the negative functions.In our country,we should set about three jobs to improve our general relief procedure: to improve the objective itself,to improve our way to realize functions as objective,and to improve the measures to reduce negative functions. |
